The problem with that is that he is going to waste resources,
either by attempting to not do that with spam (wasting cpu),
or replying to spam (wasting bandwidth).
It's much easier to just have the must-be-subscribed rule.
To address your point, I'd say all that is needed is to make
the policy obvious, say on the home page, and also posted
to the lists, say monthly.
