With patch 2.5.4:

# patch -p1 </usr/srcdevel/bbox/fix/busybox.t1/linux-2.6.13-cmdline.patch -R --dry-run
patching file init/main.c
Hunk #1 succeeded at 295 with fuzz 2 (offset 9 lines).

Seeing this (fuzz and offset) I would not expect busybox patch to work:
